You might figure, "I'll just get the notary stamp now and fill in those last few boxes later."
However, under Texas law, a Notary Public is strictly prohibited from notarizing any document that contains blank spaces or missing pages.
While this might feel like a minor administrative hurdle, it is actually one of the most powerful fraud-prevention laws we have. Here is a quick look at why complete documents matter, what exceptions exist, and how this law protects you.
The Danger of the "Blank Space"
The primary job of a notary is to ensure integrity and prevent forgery. If a notary places their official seal and signature on a document that still has empty lines, those blanks create a massive security vulnerability.
Imagine a property deed or a financial agreement signed with a blank space left under the "payment terms" or "grantee name." After the notary leaves, anyone could write in unauthorized amounts or alter names. Because the notary's stamp is already on the page, the altered document looks entirely valid to a bank or a court.
The Rule: To protect your security, a Texas notary will carefully scan your document before performing the notarization. If any blank lines, uncheck boxes, or missing sections are found within the body text, the signing must be paused until they are addressed.
Are There Any Exceptions?
Yes, but only a few very specific ones. A notary can legally proceed if the blank spaces fall into these exact categories:
Signatures of Other Parties: If a document requires multiple signers (for example, both a buyer and a seller), but only you are present for the mobile notary appointment, the other signature lines will naturally remain blank. Official Use Only Boxes: Sections clearly boxed off and labeled "For Office Use Only" or reserved for a government official (like a county clerk) are meant to be blank during your signing.
Intentional "N/A" Marks: If a line simply does not apply to your situation, you can write "N/A" (Not Applicable) or draw a neat line through the space. This shows that the space was deliberately closed off and cannot be altered later.
What Should You Do If Your Document Has Blanks?
If your mobile notary arrives and points out a blank space, don't worry—it is usually a quick fix. However, because a notary is an impartial witness, the notary cannot tell you what to write or fill the information in for you. Doing so would cross the line into unauthorized practice of law.
Here is the proper procedure to keep your appointment moving seamlessly:
1.Review the missing information: Client action.
Look closely at the blank space. If it requires specific information (like a date, an address, or a dollar amount), you must locate that data.
2.Fill in or close the blanks: Client action.
As the signer, you must physically write in the missing information yourself. If the field is completely irrelevant to your contract, write "N/A" or draw a line through it to officially close the space.
3.Execute the notarization: Notary action.
Once the document is entirely complete and secure against post-signing alterations, the notary will check your ID, witness your signature, and complete the official notary certificate.
