In the State of Texas, the answer is yes—but only if you correctly utilize a legal safeguard known as a Credible Witness.

What is a Credible Witness in Texas?

Think of a credible witness as a "human ID card." They are a third party who appears at the time of the notarization to legally vouch for the signer’s identity under oath when an acceptable government-issued photo ID is completely unavailable.

However, Texas notary laws are very strict regarding how this process can be used. According to the Texas Secretary of State and the Texas Civil Practice and Remedies Code (§ 121.005), a Texas notary can identify a principal signer using a credible witness through two distinct paths:

  • The Single Credible Witness Method: You can use one credible witness only if that witness is personally known to the notary public, personally knows the signer, and is present for the signing.

  • The Two Credible Witnesses Method: If the notary does not personally know the witness, Texas law allows the use of two credible witnesses. In this scenario, both witnesses must personally know the signer, and both must present valid, unexpired government-issued photo IDs (such as a US Passport or Texas Driver's License) to the notary.

  1. They Must Take an Oath: The notary must place the witness under a formal verbal oath or affirmation (e.g., "Do you solemnly swear under penalty of perjury that you personally know this document signer...?"). Lying under this oath carries severe legal penalties.

  2. They Must Be Impartial: While Texas statutes do not explicitly ban family members from being witnesses, industry best practices strongly dictate that the witness must be completely independent. They cannot have any financial or beneficial interest in the document being signed.

  3. Meticulous Journal Entry (No ID Numbers): Your notary must log the full name and mailing address of every credible witness used in their official journal (Texas Government Code § 406.014). Notably, Texas law explicitly prohibits notaries from recording the actual serial or identifying numbers of IDs in their journal entries, meaning an expert notary knows exactly how to protect your privacy while staying compliant.
