What Documents Can a Mobile Notary Sign? (A Texas Guide)

NOTARY PUBLIC

When you are dealing with major life events—like buying a home, setting up an estate plan, establishing a power of attorney, or signing a major business contract—you will often find a note at the bottom of your paperwork stating it requires a notary seal.

As a mobile notary service traveling across Texas, clients frequently ask us: "Can you notarize this specific document for me?"

The short answer is that a notary can notarize virtually any document that requires an impartial witness to prevent fraud, protect assets, or establish a sworn statement. However, there are a few strict legal exceptions.

To help you prepare for your appointment, here is a complete breakdown of the documents we can—and cannot—sign in the Lone Star State.

Common Documents We Frequently Notarize

Most legal documents fall into categories where verifying your identity, your willingness to sign, and your understanding of the document is required by Texas law.

1. Estate Planning & Family Law

  • Last Will and Testament & Living Trusts

  • Durable & Medical Powers of Attorney (POA)

  • Advance Healthcare Directives

  • Child Custody & Temporary Guardianship Agreements

  • Prenuptial and Postnuptial Agreements

2. Real Estate & Financial Transactions

  • Property Deeds (Warranty Deeds, Deed of Trust, Quitclaim Deeds)

  • Mortgage Closing Packages (Refinances, Purchases, Home Equity Lines of Credit)

  • Promissory Notes & Loan Agreements

  • Automobile Bills of Sale & Title Transfers

3. Business & Legal Documents

  • Affidavits & Sworn Statements (e.g., Affidavits of Heirship, Affidavits of Identity)

  • Articles of Incorporation & Partnership Agreements

  • Commercial Leases & Vendor Contracts

❌ Documents a Notary Can NEVER Sign or Certify

It is a common misconception that a notary can "certify" any official piece of paper. Under Texas law, notaries are strictly prohibited from dealing with Vital Records or Publicly Recordable Documents.

If you need official copies of the following documents, a notary cannot help you—you must contact the government agency or county clerk that originally issued them:

  • Birth Certificates

  • Marriage Licenses & Divorce Decrees

  • Death Certificates

  • School Diplomas or Transcripts (A notary cannot certify a copy of these, though they can notarize a sworn statement from a school official attaching them).

  • Federal Documents (Like naturalization papers or immigration certificates).

What You Need to Have Ready for Your Appointment

To ensure a fast, seamless, and legally compliant signing when your mobile notary arrives, please make sure you have the following three items ready:

1.A valid, unexpired photo ID:Required for all signers.

Texas law requires a current, government-issued photo ID that includes your signature (such as a Texas Driver’s License, U.S. Passport, or Military ID).

2.A completely filled-out document:Fraud prevention rule.

We cannot execute a signing if there are any blank lines or missing pages within the body of your contract. Please fill in all details (or write "N/A" where applicable) before we arrive.

3.Physical presence of all signers:Do not sign ahead of time.

Every person whose signature needs to be notarized must be physically present at the table with their ID ready. Please do not sign the paperwork before we arrive, as we must legally witness your signature.
