As a notary public serving the Houston community, I often see clients who need to get their Power of Attorney (POA) documents notarized. It's one of the most important documents you can create, and it's a key part of every good estate plan.

But what exactly is a Power of Attorney, and why is notarization so important, especially here in Houston, Texas? Let's break down the most common types of POAs and the critical role a notary plays in making them official.

While there are several types of POAs, two are by far the most requested and essential for personal and family planning in the Houston area:

  1. The Statutory Durable Power of Attorney (Financial POA): This is the workhorse of financial planning. It's a legal document that lets you appoint a trusted person (your "agent") to manage your financial and legal affairs. The "durable" part is critical because it means the document remains effective even if you become mentally incapacitated. If you become incapacitated, your family may have to go to court for a costly and time-consuming guardianship proceeding just to manage your affairs. A simple notarization can prevent this.

Tips for a Smooth Notarization

  • Do not sign the document beforehand. In most cases, you must sign the document in my presence as the notary.

  • Bring a valid photo ID. Acceptable forms of ID include a current driver's license or passport.

  • Bring the complete document. Do not bring just the signature page. I need to see the entire document to ensure it is complete.

  • The agent does not need to be present. The notary's job is to verify the identity and signature of the principal (the person granting the power). The agent (the person receiving the power) does not need to be at the signing.
