Examples of Documents That A Texas Notary Public Is Forbidden To Notarize

  • Birth and Death Certificates

  • Marriage License

  • Photographs

  • Names that do not match

  • Documents with blanks

  • Faxes or copied signatures

  • Backdate or forward date a notarization

  • Preparing or choosing the document

  • However, a Texas Notary Public is allowed to certify that a physical copy of a notarized electronic record (such as a printed copy of an electronic document) is a true and correct copy.

Notarial Act
Sometimes the notarial wording is not found on the document you need notarized.

Such examples might be handwritten or private documents. When this happens, the signer should ask the receiving agency – what type of notarization they need.

​The signer may also seek advice from an attorney or choose the act themselves. Signer then instructs the Notary to add either an acknowledgement which proves you signed the document or a Jurat where the signer swears/affirms what they signed is true.

A notary who is not an attorney cannot decide what type of notarial act a document requires for that would be “practicing law.” The customer must know and tell the notary.

All signers will need to provide a valid photo identification at the time of the appointment

What are acceptable forms of ID?

In Texas, certain standards must be met to ensure a document is legally notarized. Understanding these requirements is key to a smooth and successful notarization experience.

The only types of ID cards accepted must be issued by the State or Government. These are generally:

  • Driver License (Mexico or Canada also acceptable)

  • State ID Card

  • Military ID (An official ID card for active duty, retired, or dependent military personnel)

  • Passport (Foreign passport with USCIS stamp also acceptable)

  • Permanent resident card (For U.S permanent residents, a valid green card that the USCIS have issued can be served as government-issued photo ID)

  • Inmate ID (Texas Department of Corrections)

  • Government-issued IDs from U.S., Territories of Puerto Rico, U.S. Virgin Islands, Guam, Northern Mariana Islands, and American Samoa.

  • In Texas, foreign passports can be used for a deed or other document pertaining to a residential real estate transaction only. Therefore, Texas doesn't permit foreign passports to be used for any other type of document.


​Senior Citizens and Expired IDs

We understand that many senior citizens may have expired IDs due to no longer driving. In such cases, we require at least one credible, impartial witness who can vouch for the signer's identity. The witness must meet the identification requirements as stated above. Affidavit of Identity also will be attached together with the credible witness affidavit. This is a written statement confirming the signer's identity, signed under oath in front of the notary together with the credible witness. 

Only valid, non-expired identification, with a photograph is acceptable. The ID must contain a signature, physical descriptions, photo, and expiration to be acceptable.
NOT ACCEPTED Identity includes: Social Security Cards / Work Identification Badges / Membership Club Cards / Gym Identification Cards / Student Identification Cards / Medicare Cards / Driver’s License without Photo ID including a temporary license

If a signer cannot provide acceptable form(s) of identification, then a credible witness can be provided, by the signer, who can vouch for the identity of the signer. The credible witness MUST be able to provide one or more forms of valid identification to prove their identity, the witness must know the signer well enough to be able to swear or affirm the signer's identity before the Notary.

Please note the following:
Signing a document is important. It is therefore essential that all signatories have read the document(s) prior to signing to confirm that the data is accurate and that they can sign it as their voluntary act and deed.
  • All signatories must be present for their signatures to be notarized.

  • ​Some documents require that the notary watch you actually sign the document. You may fill in blanks and information within the document ahead of time, but do not sign or d​ate documents until you are in the presence of the notary.

  • You will need to show the notary a current photo ID such as a driver's license or a passport to confirm your identity.

Texas Notary Fees

(Effective Sept. 1, 2023)

Texas Government Code § 406.024 sets out the standard fees for a Notary Public may charge for notary public services. In addition, § 406.024 sets out the fees of an online notarization.

All services (except online notarization) delivered by Proactive Notary will incur a travel charge, which is separate from the Texas Notary Fees.​

Acknowledgements - $10 per document

  • ​An Acknowledgment / Proof of Acknowledgement is a certification that a signer personally appeared before the notary, was identified by the notary, and formally declared to the notary that the signer willingly signed the document for its intended purpose.


Jurats (Oath/Affirmation) - $10 per oath/affirmation from each individual

  • A Jurat is a certification that a signer personally appeared before the notary with an unsigned document, was identified by the notary, was put under sworn oath or affirmation to attest the statements in the document were true, then signed the document in the presence of the notary.


Certified Copy of Non-Recordable Document - $10 per certificate

  • A Certified Copy of a Non-Recordable Document is a certification that a document was presented to the notary by the document's custodian, was photocopied, and is a true, exact, complete, and unaltered copy. This document is neither a public record nor a publicly recordable document.


All Other Notarial Acts - $10

  • ​Performing any other notarial act or completing a certificate and seal not otherwise provided for under Texas Government Code § 406.024.

Yes, it is a common practice in the mobile notary industry. If a notary travels to a location and the signer cancels, the notary may charge 100% of the travel and printing fees. These fees are typically a fixed cost, and the notary will have incurred expenses (travel time, gas) even if the notarization doesn't happen.
