No, in Texas, it's not a general requirement to have a vehicle's title notarized when you're transferring ownership between two private individuals. The standard process for a title transfer does not require notarization. However, there are a few specific circumstances where a notarized document is necessary.

When Notarization Is Required

While the vehicle title itself doesn't need to be notarized, certain forms related to the transfer do in some cases. The most common instance is when a vehicle is being transferred as a gift. 🎁 In this scenario, both the donor and the recipient must complete and have the Affidavit of Motor Vehicle Gift Transfer (Form 14-317) notarized.

Additionally, if the transfer is occurring after the death of the owner and a formal probate of the estate isn't involved, you'll need a notarized Affidavit of Heirship for a Motor Vehicle (Form VTR-262).

Standard Title Transfer Process

For a regular private-party sale in Texas, you need the following:

  • Signed Title: The seller must sign the back of the title and include the odometer reading and the date of sale. The buyer will also sign the title.

  • Application for Texas Title and/or Registration (Form 130-U): This form must be completed and signed by both the buyer and the seller.

  • Proof of Insurance: The buyer needs to have valid Texas liability insurance for the vehicle.

  • Identification: Both parties should have a government-issued photo ID.

  • Payment: The buyer will need to pay the title fee, sales tax (6.25% of the purchase price or the Standard Presumptive Value, whichever is higher), and any other applicable fees.

The buyer has 30 calendar days from the date of sale to complete the title transfer at a county tax office to avoid penalties.
