How Does a Notary Verify Your Identity?

The primary role of a Notary Public is simple yet incredibly important: to prevent fraud and identity theft. The absolute best way to accomplish this is by properly verifying the identity of every single person signing a document.

Whether you are signing a property deed, a power of attorney, or business contracts, a Texas notary must ensure you are exactly who you say you are. This requires the physical, face-to-face presence (or secure, approved online presence) of all signers.

Here are the three official ways a notary can legally verify a signer's identity in the state of Texas:

1. Government-Issued Photo Identification

This is by far the most common method used during a mobile notary appointment. Under Texas law, an acceptable identification card must meet strict criteria. It must be current (not expired) and contain both a photograph and the signature of the bearer.

Commonly accepted forms of ID in Texas include:

  • Driver’s License (issued by Texas or another U.S. state)

  • State Identification Card

  • U.S. Passport or U.S. Passport Card

  • U.S. Military Identification Card

  • Permanent Resident Card or Alien Registration Card

When your notary arrives, they will carefully examine the ID to ensure it is authentic, matches your physical appearance, and matches the name listed on the document. The notary will also record the expiration date and ID number securely in their official notary journal.

2. Personal Knowledge

If the notary personally knows the signer, Texas law allows this personal relationship to serve as a valid form of identification. "Personally known" means the notary has a clean, established relationship with the individual over time, leaving no reasonable doubt about their true identity.

While legally permissible, many professional notaries still prefer to look at a physical photo ID as a best practice to ensure the highest standard of record-keeping and protection for all parties involved.

3. Credible Witnesses

What happens if a signer doesn’t have a valid, unexpired photo ID? Perhaps an elderly family member has let their driver's license expire, or a valid ID was recently lost. In Texas, we can use the Credible Witness method.

A credible witness acts as a human ID card. To use this method in Texas:

  • The witness must personally know the signer.

  • The witness must be personally known to the notary, OR they must present their own valid, unexpired government photo ID to the notary.

  • The witness must be completely neutral, meaning they cannot be named in the document, have any financial stake, or benefit from the transaction.

The notary will administer an oath or affirmation to the credible witness, who swears under penalty of perjury that the signer is indeed who they claim to be. The witness must also sign the notary's official journal.
