Can I notarize for an absent signer using an ID copy?

No, in Texas, a notary public cannot notarize a document for an absent signer using only a copy of their ID. The signer must be physically present before the notary at the time of notarization.

  • Notary's Role: the notary's role is to verify the signer's identity and witness the signing of the document. This cannot be done with a copy of an ID.

  • Exceptions: There are exceptions for remote online notarization (RON) in Texas, but that requires a live video and audio connection, not just a copy of an ID.

Acceptable forms of identification for a Texas notary include:

  • Valid, unexpired state or federal government-issued photo ID.

  • Personal knowledge of the signer by the notary.

  • Oath of a credible witness who personally knows the signer.
