The short answer in Texas is: Yes, absolutely. Texas notary law does not specify a minimum age requirement for a signer.

However, because minors cannot legally enter into most standard contracts on their own, notarizing a child's signature requires strict adherence to specific legal safeguards. Here is a clear look at how the process works in Texas and what you need to have ready before your mobile notary appointment.

The Three Crucial Rules for Notarizing a Minor's Signature

To protect your child and ensure the document stands up in a court of law, a Texas notary must verify three specific elements during the face-to-face appointment:

1. The Child Must Have Proper Identification

Just like an adult, a minor must prove who they are. Under Texas law, the ID must be current (unexpired), government-issued, and contain a physical photograph and signature.

For Teenagers: A current U.S. Passport, Passport Card, or a Texas Learner’s Permit / Driver’s License are perfect.
For Younger Children: If a young child only has a birth certificate (which contains no photo or signature and cannot be used as direct ID), Texas allows us to use the Credible Witness method. The parent or an unrelated adult who personally knows the child can present their valid photo ID and swear an official oath under penalty of perjury confirming the child’s identity.
