When you are preparing important legal or estate planning documents in Texas, you will quickly notice that many of them require two distinct things: a Notary Public’s stamp and the signatures of one or two witnesses.

If you are scheduling a mobile notary to come to your home or office, a natural question pops up: "To save time and hassle, can my mobile notary just pull double duty and act as one of my witnesses, too?"

The short answer in Texas is: Technically it is possible, but it is highly discouraged and often risky.

Here is what you need to know about how witness laws work in Texas and how to keep your documents legally airtight.

The Catch: You Can Never Notarize Your Own Signature

The primary reason a Texas notary will avoid acting as your witness comes down to a fundamental law: A notary can never, under any circumstances, notarize their own signature.

While some documents just require a witness to sign their name neatly on a line, many Texas estate and legal documents use what is called a Self-Proving Affidavit. This is incredibly common with Texas Wills.

A self-proving affidavit requires the notary to formally notarize the signatures of both the person making the will AND the witnesses.

1.Notarizing the Signer: Legal Requirement.

The notary verifies your identity and formally notarizes your signature on the affidavit.

2.Notarizing the Witnesses: Legal Requirement.

The notary must then verify the identities of the witnesses and formally notarize their signatures on that exact same page.

3.The Self-Notarization Trap: The Conflict.

If the notary signed as your witness, they would now be forced to place their official notary stamp over a block certifying their own identity and signature. This is a severe violation of Texas notary law and instantly jeopardizes the validity of your document.

Best Practices for a Seamless Signing

To protect the integrity of your contracts and estate plans, the gold standard in Texas is to keep the roles entirely separate.

Role of the Notary Public:

Who it should be: An impartial, certified third party.
What they do: Verifies identities, administers oaths, and applies the official state seal.

Role of the Document Witnesses:

Who it should be: Two independent, neutral individuals.
What they do: Watch you sign the document to verify you did so willingly and of sound mind.

Who qualifies as a good witness in Texas?

If your paperwork requires witnesses, you should gather individuals who meet these three Texas criteria:

They must be at least 18 years old.
They must be of sound mind.
They must be completely disinterested. This means they cannot be named anywhere in the document, cannot inherit anything from it, and cannot benefit financially or legally from the transaction. (Think neighbors, coworkers, or friends—avoid spouses, children, or business partners).
