Common Documents That Require Notarization

Notarization is a critical process that adds a layer of verification and security to various types of documents. As a provider of mobile notary services, I understand the importance of notarizing documents to ensure their legitimacy and binding nature. Here, I'll explore some of the most common documents that require notarization, and why it's essential to get them notarized.

Wills and Trusts

A will or trust is a legal document that outlines your wishes regarding the distribution of your assets and the care of any minor children after your death. Notarizing these documents adds a level of authenticity, making it harder for anyone to contest their validity.

Power of Attorney

A Power of Attorney (POA) is a document that grants someone else the authority to make decisions on your behalf, typically in legal, financial, or health-related matters. Notarization of a POA ensures that the signature is genuine and that the signer was not under duress or incapacitated when signing.

Real Estate Documents

Real estate transactions involve several notarized documents, such as deeds, mortgages, and escrow papers. Notarization in real estate transactions confirms the identity of the signers and helps prevent fraudulent activities.

Medical Documents

Advanced healthcare directives and medical power of attorney documents often need notarization. These documents are crucial as they outline your wishes for medical treatment if you're unable to make decisions yourself.

Business Agreements

Many business agreements, including incorporation documents, commercial leases, and loan agreements, require notarization. This process adds a layer of authenticity and enforceability to these legally binding agreements.

Affidavits

An affidavit is a written statement made under oath. Notarizing an affidavit affirms that the content is true and that the statement was made without coercion.

Divorce Decrees

In divorce proceedings, a notarized divorce decree can help ensure the document's integrity, which is essential in legal and personal matters following the dissolution of a marriage.

Notarization plays a vital role in the validation of various important documents. As a mobile notary, we bring the convenience of notarizing your critical documents to your doorstep. Whether you need a will, power of attorney, or business agreement notarized, our expert team

Texas Notary Embosser Seal Stamp Available

A notary embossed on a document provides a significant benefit by adding an extra layer of security against forgery, as the raised impression is difficult to replicate and clearly indicates the document has been officially notarized, thus enhancing its authenticity and legal validity; essentially making it harder to tamper with the document without noticeable damage.

Apostille (Document Legalization)

An apostille service is a process where a government agency, typically the Secretary of State's office, verifies the authenticity of a public document by attaching a special certification called an "apostille," allowing that document to be legally recognized in countries that are part of the Hague Convention, essentially making it valid for international use; this is often required for documents like birth certificates, marriage certificates, or diplomas when used abroad.

Obtaining an apostille for your document is a straight forward process with our assistance. The cost of an apostille may vary based on the type of document and other factors. The notary/apostille agent can guide you through the necessary steps to ensure your documents are properly authenticated.

Living Trust & Estate Planning Notary

Trusts and estates are the two main legal structures for transferring assets to your heirs and beneficiaries. Each works in critically different ways.

Estates make a one-time transfer of your assets after death.

Trusts, meanwhile, allow you to create an ongoing transfer of assets both before and after death.

You may want to consider working with a financial advisor as you weigh the relative merits of trusts and estates.

Estate Planning Notarization

If you're considering estate planning in the Houston and surrounding area, you may have questions about the associated costs and when to start the process. Estate planning costs can vary based on the complexity of your estate and the services required. It's advisable to start planning as early as possible.

Notarization at Hospitals and Nursing Homes

During hospitalization and nursing homes, family members may need significant documents notarized, such as a power of attorney or will, so that they can help sick or elderly family members handle some banking, real estate sales, or bill payment matters.

Document Type

During the hospital, nursing home, or other health care facilities stay, you may need the following notarized documents:

  • Durable Power of Attorney

  • Health Care Proxy

  • Living Will

  • Certification of Trust

  • HIPAA Waiver or Authorization for Use and Disclosure of Protected Health Information

  • Assignment of Personal Property

  • Mortgage & Banking Documents

Why notaries?

“Properties are conveyed, contracts are honored, adoptions are finalized, estate plans are established and medical wishes are respected — all because documents bearing the authenticating signature and seal of a Notary Public are trusted. The notarial act is the foundation of trust and the Notaries who perform them are Society’s guarantors of integrity and authenticity.”

Tips:

In hospitals and nursing homes, we often find that signers are unable to move around freely. They’re often stuck in a room with equipment connected to them that beeps or buzzes; armbands or leg stockings that squeeze their limbs; and IV bags hanging on poles, etc. They may be lying down, draped in a gown and thin blanket, and not physically or mentally at their finest. All, before doing the notarization, the following precautions are worth paying attention to:

  1. The signer must have a valid, unexpired government-issued photo ID.

  2. The signer must be able to understand the content and purpose of the document, sign the document voluntarily, and be able to write his own name without any help from others.

  3. The signer must not be affected by psychoactive substances such as painkillers, drugs, tranquilizers, alcohol, etc. He or she should be alert, aware, and willing to sign documents. To protect the signer, the notary will refuse to notarize any patient or signer who appears to be mentally unsound or incapacitated.

  4. If the signer’s family or other visitors cause any kind of commotion, the notary may ask them to leave the room temporarily to ensure that the signer is not under external pressure or command.

  5. Before the notary arrives, the signer should prepare completed documents with no blanks (except for the signature and notarial certificates part).

  6. If witnesses are needed, please ensure that the witness is also present. Generally speaking, a witness must be at least 18 years old, of sound mind, and have no interest in the parties. It is the obligation of the signer to find witnesses.

  7. The duty of a notary is to verify the identity of the signer and their willingness to sign the documents, not to provide legal advice. For details of the documents, please confirm with lawyers, professionals, or individuals or organizations requesting documents.

Legal Documents

Court documents, employee verification, address verification, credible witness & various other sworn statements. Affidavit of election, international adoption documents, name change, etc.

Certified Copies

Texas permits Notaries to certify a copy only if the original is a non-recordable document. A potentially recordable document cannot be copy certified.

If a notary cannot certify a copy of a document, is there an alternative? Yes, an alternative procedure called "copy certification by document custodian" may be permissible. With this procedure, the document's custodian or holder signs a statement attesting to the accuracy of the copy, and the Notary notarizes the custodian's signature on the statement. The difference is that rather than directly certifying the copy, the Notary is notarizing the custodian's signature on a statement vouching for the copy's accuracy.

Lost or Expired Identification?

How can I get something notarized without an identification in the State of Texas? It's really easy & simple. We can help you navigate through the easy process and get your document notarized in no time.

Be Prepared: What you need to bring as a signer for notarization

Identifying the Signer's Identity

All signers must have an active (unexpired) government-issued picture identification at the time of notary appointment that includes a physical description, photograph, and signature. The ID card should typically detail eye and hair color, height, weight, and date of birth.

Passport, Driver License, State ID, Military ID, and Inmate ID Card. The name on the ID MUST MATCH the name on the document being notarized.

Other form of identification

Credible Witness

Texas allows Notaries to identify the signer through a credible identifying witness. A credible witness is an individual who personally knows the signer and can vouch for the signer’s identity to the Notary.

In Texas, a credible witness must either personally know the Notary or must present to the Notary a valid, unexpired ID issued by the federal or a state government that contains the photo and signature of the witness (1 TAC 87.40[2] and 87.1[1]).

A credible witness must know the signer well enough to be able to swear or affirm the signer’s identity before the Notary.

(Of course, if the witness lies in swearing to know the signer, the witness will be subject to the penalty of perjury.)

Simply asking the credible witness to identify the signer is not sufficient. The notary will have the credible witness sign an entry in the notary record book for that transaction detailing the oath of credible witness and, of course, have the signer of the document being executed sign in the next entry for that notarial act.

Under state law, Government Code Section 406.014(6) requires Texas Notaries to record the following information in the journal entry when a credible witness identifies a signer:

1. The name of the credible witness.
2. The residence address of the credible witness.

Before meeting with a notary, ensure all details on the document are completed, including dates, addresses, descriptions, and any other necessary information, except for the signature line which should be left blank for you to sign in the notary's presence.
Yes, it is a common practice in the mobile notary industry. If a notary travels to a location and the signer cancels, the notary may charge 100% of the travel and printing fees. These fees are typically a fixed cost, and the notary will have incurred expenses (travel time, gas) even if the notarization doesn't happen.
