Tips:

In hospitals and nursing homes, we often find that signers are unable to move around freely. They’re often stuck in a room with equipment connected to them that beeps or buzzes; armbands or leg stockings that squeeze their limbs; and IV bags hanging on poles, etc. They may be lying down, draped in a gown and thin blanket, and not physically or mentally at their finest. All, before doing the notarization, the following precautions are worth paying attention to:

1. The signer must have a valid, unexpired government-issued photo ID.

2. The signer must be able to understand the content and purpose of the document, sign the document voluntarily, and be able to write his own name without any help from others.

3. The signer must not be affected by psychoactive substances such as painkillers, drugs, tranquilizers, alcohol, etc. He or she should be alert, aware, and willing to sign documents. To protect the signer, the notary will refuse to notarize any patient or signer who appears to be mentally unsound or incapacitated.

4. If the signer’s family or other visitors cause any kind of commotion, the notary may ask them to leave the room temporarily to ensure that the signer is not under external pressure or command.

5. Before the notary arrives, the signer should prepare completed documents with no blanks (except for the signature and notarial certificates part).

6. If witnesses are needed, please ensure that the witness is also present. Generally speaking, a witness must be at least 18 years old, of sound mind, and have no interest in the parties. It is the obligation of the signer to find witnesses.

7. The duty of a notary is to verify the identity of the signer and their willingness to sign the documents, not to provide legal advice. For details of the documents, please confirm with lawyers, professionals, or individuals or organizations requesting documents.

Certified Copies

Texas permits Notaries to certify a copy only if the original is a non-recordable document. A potentially recordable document cannot be copy certified.

If a notary cannot certify a copy of a document, is there an alternative? Yes, an alternative procedure called "copy certification by document custodian" may be permissible. With this procedure, the document's custodian or holder signs a statement attesting to the accuracy of the copy, and the Notary notarizes the custodian's signature on the statement. The difference is that rather than directly certifying the copy, the Notary is notarizing the custodian's signature on a statement vouching for the copy's accuracy.

Be Prepared: What you need to bring as a signer for notarization

Identifying the Signer's Identity

All signers must have an active (unexpired) government-issued picture identification at the time of notary appointment that includes a physical description, photograph, and signature. The ID card should typically detail eye and hair color, height, weight, and date of birth.

Passport, Driver License, State ID, Military ID, and Inmate ID Card. The name on the ID MUST MATCH the name on the document being notarized.

Credible Witness

Texas allows Notaries to identify the signer through two credible identifying witnesses. Credible witnesses are individuals who personally knows the signer and can vouch for the signer’s identity to the Notary.

In Texas, a credible witness must either personally know the Notary or must present to the Notary a valid, unexpired ID issued by the federal or a state government that contains the photo and signature of the witness (1 TAC 87.40[2] and 87.1[1]).

The two credible witnesses must know the signer well enough to be able to swear or affirm the signer’s identity before the Notary.

(Of course, if the witnesses lies in swearing to know the signer, the witnesses will be subject to the penalty of perjury.)

Simply asking the credible witnesses to identify the signer is not sufficient. The notary will have the credible witnesses sign an entries in the notary record book for that transaction detailing the oaths of credible witnesses and, of course, have the signer of the document being executed sign in the next entry for that notarial act.

Under state law, Government Code Section 406.014(6) requires Texas Notaries to record the following information in the journal entry when any credible witnesses identifies a signer:

1. The name of the credible witnesses.
2. The residence address of the credible witnesses.

Before meeting with a notary, ensure all details on the document are completed, including dates, addresses, descriptions, and any other necessary information, except for the signature line which should be left blank for you to sign in the notary's presence.

Yes, it is a common practice in the mobile notary industry. If a notary travels to a location and the signer cancels, the notary may charge 100% of the travel and printing fees. These fees are typically a fixed cost, and the notary will have incurred expenses (travel time, gas) even if the notarization doesn't happen.
